Before filing a trademark application, it is crucial to conduct a comprehensive search to ensure that the desired trademark is not already in use by another company. This search helps avoid potential conflicts and rejection of the application.
Once we have determined that the desired marks are available, we will file your application with the United States Patent and Trademark Office in Washington, D.C.
After your application is filed, it is assigned to an examining attorney at the USPTO. The examining attorney reviews the application to ensure it meets all legal requirements and does not conflict with existing trademark registrations. If the application meets all criteria, it proceeds to the next step. Otherwise, the applicant may need to respond to objections raised by the examining attorney.
Once the examining attorney approves the mark, it is then published in the Trademark Official Gazette, a weekly publication of the USPTO. If anyone opposes issuance, they file a notice of opposition. If opposition is filed, the Trademark Trial and Appeals Board hears the dispute.
If no opposition is filed or if opposition is resolved in favor of the applicant, the trademark is registered and a registration certificate is issued. Registration provides the owner with exclusive rights to use the trademark in connection with the goods or services specified in the registration.
Trademarks typically require periodic maintenance and renewal to remain in force. This involves filing maintenance documents and paying renewal fees at specified intervals.
